About GDPR

The General Data Protection Regulation (GDPR) is a comprehensive data protection law that came into effect on 25 May 2018. It gives individuals greater control over their personal data and places obligations on organisations that collect, process, or store personal information.

Calmplover is committed to complying with GDPR requirements and protecting the personal data of all individuals who interact with our services.

Data Controller

Calmplover acts as the data controller for personal information collected through our website and services. This means we determine the purposes and means of processing your personal data.

Your Rights Under GDPR

Under the GDPR, you have the following rights regarding your personal data:

Right to Access (Article 15)

You have the right to request a copy of the personal data we hold about you. We will provide this information free of charge within one month of receiving your request.

Right to Rectification (Article 16)

If you believe any personal data we hold about you is inaccurate or incomplete, you have the right to request correction. We will respond to such requests within one month.

Right to Erasure (Article 17)

Also known as the "right to be forgotten", you may request deletion of your personal data in certain circumstances, including:

  • The data is no longer necessary for the purpose it was collected
  • You withdraw consent and there is no other legal basis for processing
  • You object to processing and there are no overriding legitimate grounds
  • The data has been unlawfully processed

Right to Restrict Processing (Article 18)

You may request that we limit the processing of your personal data in certain situations, such as when you contest the accuracy of the data or object to processing.

Right to Data Portability (Article 20)

Where technically feasible, you have the right to receive your personal data in a structured, commonly used, and machine-readable format, and to transmit that data to another controller.

Right to Object (Article 21)

You have the right to object to processing of your personal data based on legitimate interests or for direct marketing purposes. We will stop processing unless we can demonstrate compelling legitimate grounds.

Rights Related to Automated Decision-Making (Article 22)

You have the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. We do not currently use automated decision-making processes.

Exercising Your Rights

To exercise any of these rights, please contact us at the address above. We may need to verify your identity before processing your request. We aim to respond to all valid requests within one month, though complex requests may take up to three months.

Legal Basis for Processing

We process personal data under the following legal bases as defined by GDPR:

  • Consent (Article 6(1)(a)): Where you have given clear consent for us to process your personal data for a specific purpose
  • Contract (Article 6(1)(b)): Where processing is necessary for the performance of a contract with you or to take steps at your request before entering into a contract
  • Legal Obligation (Article 6(1)(c)): Where processing is necessary for compliance with a legal obligation
  • Legitimate Interests (Article 6(1)(f)): Where processing is necessary for our legitimate interests or those of a third party, except where overridden by your interests, rights, or freedoms

Data Transfers

We primarily process and store data within the United Kingdom and European Economic Area. If we transfer data outside these areas, we ensure appropriate safeguards are in place, such as standard contractual clauses approved by the European Commission.

Data Breach Notification

In the event of a personal data breach that poses a risk to your rights and freedoms, we will notify the relevant supervisory authority within 72 hours. If the breach is likely to result in high risk to you, we will also notify you directly.

Supervisory Authority

If you are unsatisfied with how we handle your personal data or respond to your requests, you have the right to lodge a complaint with a supervisory authority. In the United Kingdom, this is:

Information Commissioner's Office (ICO)
Wycliffe House
